Welcome to MDRN Auto! The terms “we,” “us,” and “our” refer to MDRN Auto. We operate this store and website, including related information, content, features, tools, products, and services (the “Services”). MDRN Auto is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with the policies referenced herein, describe your rights and responsibilities when using the Services.
Please read these Terms carefully. They contain important information about warranties, limitations of liability, and your legal rights.

SECTION 1 – ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your state of residence. If you permit minor dependents to use the Services, you are responsible for supervising their use.
You may be asked to provide information such as your email address, billing details, payment information, and shipping address. You agree to provide accurate, current, and complete information and represent that you are authorized to provide it.
You are responsible for maintaining the security of your account credentials and for activity you authorize through your account. Please notify us promptly of suspected unauthorized access.
You may not transfer, sell, assign, or license your account to another person.
SECTION 2 – OUR PRODUCTS
We make reasonable efforts to accurately describe and display our products. Colors and appearance may vary depending on your screen and device settings. These variations do not limit your rights if a product is defective or materially different from its description.
Please review each product’s listed vehicle models, model years, dimensions, and installation requirements before purchasing. Compatibility applies only as described in the product listing.
Follow all manufacturer instructions for installation and use. Products must not interfere with vehicle controls, airbags, seat belts, visibility, or other safety systems.
References to vehicle manufacturers and models identify compatibility only and do not imply affiliation or endorsement unless expressly stated.
We may update product descriptions, discontinue products, or limit quantities. Changes to listings do not alter our obligations for previously accepted orders.
SECTION 3 – ORDERS
Placing an order constitutes an offer to purchase. We may accept or decline orders for lawful reasons, including product availability, payment problems, suspected fraud, or listing errors.
An automated order acknowledgment does not necessarily constitute acceptance. Acceptance occurs when we expressly confirm acceptance or ship your order.
If we decline or cancel an order after collecting payment, we will notify you and refund the amount paid for the canceled items, including applicable taxes and shipping charges.
To request an order change or cancellation, contact mdrnautoaccessories@gmail.com as soon as possible. We will try to accommodate your request, but changes or cancellations may not be possible once fulfillment has begun.
Orders already shipped cannot be modified or canceled through our ordinary cancellation process. This does not limit any cancellation or refund rights under applicable law.

SECTION 4 – PRICES AND BILLING
Prices, discounts, and promotions may change. Changes do not apply retroactively to accepted orders.
Unless otherwise stated, displayed product prices exclude shipping charges and applicable taxes. Applicable charges will be displayed at checkout before purchase.
Promotions may have separate terms. Those terms govern the promotion if they conflict with these Terms.
You agree to provide accurate and current purchase, payment, and account information. You represent that you are authorized to use the payment method submitted.
SECTION 5 – SHIPPING AND DELIVERY
We currently ship within the United States. Shipping rates, processing information, and delivery details are described in our Shipping Policy:

Delivery estimates are not guaranteed arrival dates. If we cannot ship within the stated processing timeframe, we will notify you of the delay and provide cancellation or consent options as required by applicable law.
If your package is lost, damaged, delayed, or incorrect, contact mdrnautoaccessories@gmail.com with your order number. We will investigate with the carrier or fulfillment partner and arrange an appropriate resolution.
Nothing in these Terms limits your rights under applicable consumer protection laws.
SECTION 6 – INTELLECTUAL PROPERTY
The Services, including our original text, graphics, logos, images, videos, and their arrangement, are owned by MDRN Auto or used with permission from the relevant owners and are protected by applicable intellectual property laws.
You may access and use the Services for personal shopping and other permitted purposes. Except as permitted by law, you may not reproduce, distribute, modify, republish, or commercially exploit protected content without permission from the relevant rights holder.
MDRN Auto’s names, logos, and branding belong to MDRN Auto. Shopify’s names and branding belong to Shopify. Third-party product names, logos, and trademarks belong to their respective owners.
Nothing in these Terms grants ownership of or an unrestricted license to any intellectual property.
SECTION 7 – OPTIONAL TOOLS
The Services may provide access to optional tools operated by third parties. We do not control those tools and do not guarantee their availability, accuracy, or performance.
To the extent permitted by law, optional third-party tools are provided “as is” and “as available.” Their use may be subject to the provider’s separate terms and privacy policies.
New features or tools added to our Services will also be subject to these Terms unless separate terms are provided.
SECTION 8 – THIRD-PARTY LINKS
The Services may include links to third-party websites or content. These links do not necessarily constitute endorsement.
We do not control third-party websites and are not responsible for their content, practices, or independent transactions. Please review their terms and privacy policies before using them.
This section does not transfer responsibility for purchases made directly from MDRN Auto to our suppliers or fulfillment partners.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
MDRN Auto is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with MDRN Auto. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and MDRN Auto, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with MDRN Auto.

SECTION 11 – FEEDBACK AND REVIEWS
If you submit reviews, suggestions, ideas, or other content (“Feedback”), you grant us a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, publish, distribute, and display that Feedback to operate, improve, and promote the Services.
You retain ownership of your Feedback. You represent that you own or have permission to submit it and that it does not violate another person’s rights.
Feedback must not contain unlawful material, threats, malware, impersonation, or misleading claims. You must disclose compensation or incentives received in connection with a review.
We may remove Feedback that violates these Terms. We will not prohibit or penalize honest reviews merely because they are negative.
Do not submit confidential information through public reviews or unsolicited suggestions. Personal information remains subject to our Privacy Policy.
SECTION 12 – ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain errors relating to descriptions, pricing, promotions, shipping charges, delivery estimates, or availability.
We may correct errors and update information. If an error affects your order, we will contact you as appropriate. We will not increase the price of an accepted order without your consent.
If an order is canceled because of an error, amounts paid for the canceled items, including applicable taxes and shipping charges, will be refunded.

You may use the Services only for lawful purposes.
You must not:
• Violate applicable laws or another person’s rights.
• Submit fraudulent orders or false payment information.
• Harass, threaten, or unlawfully discriminate against others.
• Impersonate another person or entity.
• Send spam or unauthorized solicitations.
• Upload malware or interfere with the Services.
• Collect personal information without authorization.
• Copy or commercially exploit protected content without permission.
• Bypass security controls or access restricted systems.
• Use automated tools in violation of Section 14.
We may restrict or suspend access where reasonably necessary to address violations, fraud, or security risks.

An “Agent” is software or a service that takes autonomous or semi-autonomous actions on behalf of a person or entity.
Agents accessing the Services must identify themselves, comply with applicable access restrictions, and stop accessing the Services if we request it.
Where an Agent makes HTTP or HTTPS requests, it must identify itself in its user-agent string using “Agent/[agent name].”
Agents must not conceal their automated nature, impersonate human users, circumvent CAPTCHAs or security measures, or provide false responses when asked whether they are automated.
We may limit or block automated access to protect the Services. An Agent’s use does not remove the user’s responsibilities under these Terms.
SECTION 15 – TERMINATION
We may suspend or terminate access to the Services for violations of these Terms or where reasonably necessary to prevent fraud, security threats, or unlawful conduct.
Termination does not eliminate obligations relating to accepted orders, refunds, or rights under applicable law.
Provisions that by their nature should survive termination will remain in effect, including intellectual property, Feedback licenses, applicable liability limitations, dispute provisions, and outstanding payment obligations.
SECTION 16 – DISCLAIMER OF WARRANTIES
We do not guarantee that the website will operate without interruption or error.
TO THE EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
PRODUCT WARRANTIES, IF ANY, ARE AS DESCRIBED IN THE APPLICABLE PRODUCT LISTING OR WARRANTY DOCUMENTATION. ANY DISCLAIMER OF IMPLIED WARRANTIES APPLIES ONLY TO THE EXTENT PERMITTED BY LAW.
NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, OR OVERRIDES EXPRESS PRODUCT DESCRIPTIONS OR PROMISES WE MAKE.
SECTION 17 – LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, MDRN AUTO AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL LOSSES ARISING FROM USE OF THE SERVICES.
THIS LIMITATION DOES NOT EXCLUDE LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER CONDUCT WHERE LIMITATION IS PROHIBITED BY LAW.
NOTHING IN THIS SECTION ELIMINATES YOUR RIGHT TO A REFUND OR OTHER REMEDY REQUIRED BY APPLICABLE LAW.
SECTION 18 – INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless MDRN Auto, Shopify, and their respective service providers from third-party claims and reasonable costs arising from your unlawful use of the Services, infringement of another person’s rights, or material breach of these Terms.
This obligation does not apply to the extent a claim results from the protected party’s own negligence, misconduct, or violation of law.
We will provide reasonable notice of a claim and an opportunity to cooperate in its defense. We will not agree to a settlement that imposes obligations on you without your consent.
SECTION 19 – SEVERABILITY
If a provision of these Terms is found unlawful or unenforceable, it will be limited or severed to the extent necessary. The remaining provisions will remain effective.
SECTION 20 – WAIVER AND ENTIRE AGREEMENT
Failure to enforce a provision does not waive the right to enforce it later.
These Terms and the policies incorporated by reference constitute the agreement governing use of the Services, subject to applicable law and any express terms provided with a purchase.
Nothing in these Terms excludes representations or rights that cannot lawfully be excluded.
SECTION 21 – ASSIGNMENT
You may not transfer your rights or obligations under these Terms without our written consent, except where permitted by law.
We may transfer these Terms as part of a lawful business transfer, provided the transfer does not reduce obligations owed to you for existing orders or mandatory consumer rights.
SECTION 22 – GOVERNING LAW
These Terms and any separate agreements through which we provide the Services are governed by the laws of the State of California and applicable federal laws of the United States.
Subject to applicable law, disputes will be heard in the state or federal courts serving Kern County, California.
Nothing in this section limits mandatory consumer protections or rights to bring a claim in another jurisdiction where applicable law permits.

Continued use of the Services after updated Terms take effect constitutes acceptance to the extent permitted by law.
